RiverLink Unpaid Toll Fees $2.5M Class Action Settlement - Top Class Actions

Two toll companies agreed to a $2.5 million settlement to resolve class action lawsuit claims they unfairly charged fees on unpaid tolls for the RiverLink toll bridges in Indiana and Kentucky.

The settlement benefits individuals who paid fees or penalties on tolls related to use of the RiverLink toll bridges and were not refunded before Feb. 7, 2022. Eligible fees would have been assessed after Class Members failed to pay a first toll notice, second toll notice, and/or violation notice that was not printed and mailed. 

RiverLink toll bridges allow traffic to cross the Ohio River between Louisville, Kentucky, and southern Indiana. Three bridges connect the two states, allowing drivers to cross the river in exchange for a toll.

According to a class action lawsuit, RiverLink operators Kapsch TrafficCom USA Inc. and Gila Inc. violate the law by charging late fees on unpaid tolls after only 29 days or fewer. Plaintiffs in the case say the RiverLink business terms are supposed to allow 35 days for payment — five days for invoice generation and mailing and 30 days for a customer to make payments.

As a result of this failure, drivers were allegedly charged unfair late fees on unpaid tolls before their payments should have been considered late.

“Defendants have inappropriately charged motorists penalties as part of a scheme with the intent to defraud and mislead,” the RiverLink class action lawsuit contends.

Kapsch and Gila haven’t admitted any wrongdoing but agreed to settle these claims with a $2.5 million settlement deal.

Under the settlement terms, Class Members will receive a cash payment. This payment will vary depending on the amount each Class Member paid in toll fees. Class Members who paid more in toll fees will be allotted a larger share of the settlement fund. No payment estimates are available on the settlement website. 

Both defendants also agreed to make changes to their toll fee processes to avoid future unfair fees. This serves as injunctive relief in the settlement deal.

The deadline for exclusion and objection is May 23, 2022. 

The final approval hearing for the settlement is scheduled for June 22, 2022.

Class Members do not have to file a claim form in order to benefit from the settlement. They will automatically receive payments without needing to take any action. 

However, Class Members may elect to receive their payment through PayPal or Zelle by submitting a request through the settlement website.

Please Add me I was moving when I crossed the River Link bridge and when I got the first bill it had two different dates and times charging me $4.42 so I paid it with a money order and I used my married name and new address and they sent me another bill not even two weeks later, the payment was sent to KY.

My address and vehicle/plate information has changed since I had to pay 2 ridiculously high fines to riverlink. The contact number for the class administrator has no way to leave a message , how do I update my information to receive payment ??

I paid tolls in Indiana.

I had taken care of my dad before he passed away and had to go from Kentucky to Indiana every day, last year I paid 500 dollars, this year they are claiming I owe 1000 dollars I had to pay in order to get my license and registration they are over feeling people

Add me. I traveled that bridge 3 times before a supposed Bill that I never received was never generated. I lived in Indiana and had traveled back and forth to Florida. Because I never got the invoice ….my actual license plates were suspended. So the 4 dollar toll ended up costing me 68 dollars. I definitely need added.

It happend to me again, this week. I was never notified or added to this settlement.

Add me please I’ve lived in Cincinnati Ohio my whole life and I have traveled that bridge my entire life basically and I have never been paid a cent back nor have I received a claim number to be compensated. Thank you

I have lived at the same address for 6 years and never received a bill. In 2018, I tried to renew my tags and was unable to until I paid the riverlink bill. I crossed the toll bridges numerous times, but nowhere close to the $1500 that they charged me for. But that was because they gave me $29 late fees for each time I crossed. I don’t make very good money and had to quit driving for a long time because of it. Even though I have talked to river link numerous times I still don’t receive any bill from them. But my license address hasn’t changed since this started. That company is a total scam and it really made my life complicated in many ways.

Would like to be added to this, I commute daily From Louisville, Kentucky to Jeffersonville, Indiana and it’s a pain with charges.. How do I get justice when I haven’t received a claim number and I have not been compensated before 02-07-2022.
